Governance: Licensing Program

Purpose
The intent of this policy is to minimize public confusion about the source of Lamaze programs, activities and materials conducted by components of Lamaze International, and to maintain Lamaze International’s right to control the quality of the goods or services that are offered in conjunction with the Lamaze Licensed Marks.

The Lamaze Licensed Marks may be used, as specified in this policy, for purposes which advance the Lamaze mission, which is to promote, support and protect natural, safe and healthy birth through education and advocacy.  Use of the Lamaze Licensed Marks will be monitored and controlled by the executive director, under policy direction of the Lamaze International Board of Directors.  No individual or group may use the Lamaze Licensed Marks without the express written consent of the executive director and majority vote of the Lamaze International Board of Directors, except as allowed below.

This policy has been adopted to assure that the Lamaze name continues to be trusted and known for promoting normal, natural, healthy and fulfilling childbirth experiences for women and their families around the world. To protect our respected reputation and name recognition, Lamaze International has developed a formalized Lamaze Licensing Program, which is available to Lamaze International members, Lamaze Certified Childbirth Educators (LCCE educators), Lamaze International Chapters, and Lamaze Accredited Childbirth Educator Programs.

Lamaze Licensed Marks
It is the policy of Lamaze International that members, LCCE educators, chapters and childbirth educator programs may by licensed from Lamaze International to use the Lamaze®  mark, the Belly Logo marks and the Certification Seal, to promote childbirth education services as specified herein. No individual or group may use the Licensed Marks other than by license from Lamaze International, Inc. Lamaze International, Inc. is the exclusive owner of these Lamaze Licensed Marks.
 
License Eligibility
There are four basic categories of individuals and groups affiliated with Lamaze International who may use the Licensed Marks as indicated below, strictly as specified in this policy: Lamaze International members; Lamaze Certified Childbirth Educators (LCCE educators) members/non-member; Lamaze International Chapters; and Lamaze Accredited Childbirth Educator Programs.

Lamaze International Members Who Are Not LCCE Educators
Lamaze International members who are not LCCE educators agree, in their applications/renewals for membership, to abide by Lamaze International bylaws, rules and policies, including those concerning use of the Lamaze Licensed Marks of the organization. Current members of Lamaze International who are not LCCE educator certified are licensed only to identify themselves as "a member of Lamaze® International" or "a member of Lamaze®".

Lamaze International policy prohibits members who are not LCCE educator certified from stating or implying that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education.

Lamaze International Members Who Are LCCE Certified
Lamaze International members who are LCCE educators agree, in their applications/renewals for membership, to abide by Lamaze International Inc. bylaws, rules and policies, including those concerning use of the Lamaze Licensed Marks. They also agree, when applying for certification/recertification, that they will abide by the code of ethics established by the Lamaze Certification Council and Lamaze International, Inc. including those concerning use of the Licensed Marks. As long as members who are LCCE certified remain in good standing, they are licensed to use the Lamaze Licensed Marks in the promotion of the Lamaze ® as follows: 

  • To identify themselves as "a member of Lamaze® International" or "a member of Lamaze®." 
  • To indicate that they are "certified by Lamaze®" or are a "Lamaze Certified Childbirth Educator" or are "LCCE certified."
  • To state that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education and make reference to the Lamaze Healthy Birth Practices.  
  • To use the Lamaze Certification Seal in the promotion of the Lamaze® childbirth education.
  • To use the Lamaze Belly Logo mark with the words 'Lamaze Certified Childbirth Educator & Member' in the promotion of the Lamaze childbirth education. 

Lamaze Certified Childbirth Educators Who Are Not Members
Lamaze Certified Childbirth Educators (LCCE educators) who are non-members agree, when applying for certification/recertification, that they will abide by the code of ethics for LCCE educators and policies established by the Certification Council and Lamaze International, including those concerning use of the Lamaze Licensed Marks. As long as non-member LCCE educators remain LCCE educators in good standing, they are licensed to use the Lamaze Licensed Marks in the promotion of the Lamaze childbirth education as follows:

  • To indicate that they are "certified by Lamaze®" or are a "Lamaze® Certified Childbirth Educator" or "LCCE certified."
  • To state that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education and make reference to the Lamaze Healthy Birth Practices.
  • To use the Lamaze Certification Seal in the promotion of the Lamaze® childbirth education. 
  • Lamaze International policy prohibits the use of the Belly Logo by LCCE educators who are not members of Lamaze International.

Lamaze Childbirth Educator Programs
Each Lamaze Childbirth Educator Program executes an accreditation agreement and license which includes provisions regarding the following use of the Lamaze Licensed Marks:

  • To state that the licensee offers the "Lamaze Childbirth Educator Program" (as long as the separately incorporated status of the program is disclosed).
  • To represent that the purpose of the licensee’s Lamaze Childbirth Educator Program is to teach students in the instruction of the Lamaze childbirth education and to prepare students to sit for the Lamaze examination to become certified by Lamaze.
  • To use the Lamaze Belly Logo mark with the words “Lamaze® Accredited Childbirth Educator Program” in communications material.     

Lamaze International Chapters
Each Lamaze International Chapter executes a charter which includes provisions regarding the following use of the Lamaze Licensed Marks: 

  • To identify the chapter as a "chapter of Lamaze International" or "a Lamaze International chapter" (as long as the separately incorporated status of the chapter is disclosed).
  • To use the Lamaze Belly Logo mark with the words 'Chapter of Lamaze® International' in communications material.
  • While Lamaze International chapters are allowed to use the Lamaze® mark and the Belly Logo for chapters as part of their organization identification, chapters are not authorized to license or permit the use of the name/logo by their individual members.

How to Use the Lamaze Licensed Mark
Licensed individuals or organizations may use the Lamaze Licensed Marks on business cards and stationary in accordance with this policy, without additional written permission. Each use of the Lamaze Licensed Marks must prominently identify the licensee’s relationship with Lamaze International and must fully comply with Lamaze International graphics standards and all other licensing requirements.  Please see “Graphic Guidelines for Use of the Lamaze Licensed Marks” for more information.

The mark Lamaze may not be used as part of a domain name.  None of the Lamaze Licensed Marks may be used in a manner that states or implies any connection with Lamaze International other than the individual’s or organization’s actual relationship as a member, LCCE educator, chapter or program. Lamaze International, Inc. will exercise control over the quality of goods and services offered in conjunction with the marks. 

Requests for use of the Lamaze Licensed Marks on promotional materials other than business cards and stationery (such as Web sites, brochures, flyers, and display ads) must be submitted in writing to the executive director.  The written request must (1) detail the specific and (2) include samples of the planned materials.  The information and materials will be evaluated for compliance with this policy, including graphic standards for the Lamaze Licensed Marks and adherence to Lamaze International philosophies, policies and principles.  If the request includes a proposed use of the Lamaze Licensed Marks in connection with a Web site, you must provide a WHOIS printout establishing that you own and control the relevant URL.

The Lamaze Licensed Marks may not be used in a manner which is in conflict with Lamaze International philosophy, policies or principles. In case of uncertainty on proper use of the Licensed Marks, contact the Lamaze Administrative Office. Lamaze International, Inc. has the right, at its sole discretion, to determine whether a proposed use of the Lamaze Licensed Marks is consistent with the rules and policies of the Lamaze Licensing Program.

Graphic Guidelines for Use of the Lamaze® Licensed Marks

Artwork
The Lamaze Belly Logo marks and Certification Seal must be reproduced to graphic standards developed by Lamaze International, Inc., and from logo specimins obtained through Lamaze International, Inc. Original artwork may not be developed by any individual, company or organization other than Lamaze International. Camera-ready artwork will be provided to all users of the Lamaze Belly Logo marks and Certification Seal. No alterations may be made to the Licensed Marks. Additional artwork, if needed, must be obtained from Lamaze International, Inc.

Colors
The colors for the Lamaze Belly Logo marks are Pantone Matching System 2745 (purple) and 7474 (teal) or black. The color for the Certification Seal is Pantone Matching System 2745 (purple) or black. Any use of other colors for reproduction of the Belly Logo marks or Certification Seal must receive prior written approval from Lamaze International, Inc.

Size
The Lamaze Belly Logo marks and Certification Seal are ideal for use on stationery and business cards. They must be at least 9/16” width. The Belly Logo marks and Certification Seal should always appear in connection with the full name of the licensed member, the LCCE, the program, or the chapter.

Printing
The Lamaze Belly Logo marks and Certification Seal may be reproduced in positive form only.

Positioning
The Lamaze International and Lamaze® marks, the Belly Logo marks and Certification Seal must always be positioned independently of a company trademark and may not be incorporated into a company logo or brand name.

Trademark Notation
The symbol “®” stands for registered trademark. The appropriate symbol “®” must always clearly accompany the Licensed Marks as shown on the official logo sheet. In addition, the use of the mark Lamaze®, as permitted under the terms of the license agreement, should be accompanied by “®.” Promotional material, such as brochures and flyers, must include the following notation: “Lamaze is a registered trademark of Lamaze International, Inc.”

Style of the Lamaze Marks
When using Lamaze® International and Lamaze®, the marks must begin with uppercase letters with the remainder of the letters presented in lowercase. The standard font type of the Lamaze® International and Lamaze® marks is Times New Roman.

Applying for Use of the Lamaze® Licensed Marks
The Lamaze® mark, the Belly Logo marks and the Certification Seal are trademarks owned exclusively by Lamaze International, Inc. Use of these trademarks by approved individuals and organizations is only by license from Lamaze International, Inc. as stated in this policy. Use in any other circumstances without written consent from Lamaze International, Inc. constitutes infringement and/or misappropriation and is subject to legal action. Lamaze International, Inc. retains the right to rescind, at its sole discretion, permission if the Lamaze Licensed Marks are used improperly in any way. 

Lamaze International members and/or LCCE educators are licensed to use certain terms/marks as outlined in this licensing program without further action. Only those individuals desiring to use the marks in a manner not already licensed are required to submit a licensing application form. For example, a member LCCE educator who only intends to use the Lamaze Licensed Marks as specified in this licensing policy need not submit any further application. The licensing agreement for these uses has been covered by membership and recertification applications. However, a member LCCE educator who would like to use the Lamaze Licensed Marks on promotional materials, such as brochures and flyers, must submit an application for use of these Licensed Marks. 

Chapter and programs must sign a separate agreement with Lamaze International, Inc. allowing use of the Lamaze Licensed Marks. Any use beyond that allowed by separate agreement must be applied for using the licensing application form.

To apply for permission to use the Lamaze Licensed Marks, please complete the attached application form, retain a copy for your records and return the original to Lamaze International, Inc. If approved, camera-ready artwork will be sent to you within four to six weeks. 

Rules for Use of the Lamaze® Licensed Marks:

  • Individuals or organizations that use the Lamaze® Licensed Marks must agree to comply with the following:
  • All use of the Lamaze Licensed Marks must be in conformance with the philosophies, principles and written policies of Lamaze International, Inc., which may be revised from time to time;
  • All use of the Licensed Marks must comply with Lamaze International graphic standards, which may be revised from time to time;
  • Lamaze International, Inc., will exercise control over the quality of goods or services used in conjunction with the Licensed Marks;
  • All use of the Licensed Marks must clearly identify the licensee's relationship with Lamaze International, Inc., (i.e., member, LCCE educator, chapter or program);
  • The Licensed Marks may be used by the licensee only in conjunction with the provision of childbirth education services and may not be used in conjunction with the provision of any other goods or services by licensees;
  • None of the Lamaze Licensed Marks, including the marks LAMAZE and LAMAZE INTERNATIONAL, may be used as part of any domain name; 
  • The appropriate symbol "®" must always clearly accompany the Licensed Marks as shown on the official logo sheet. In addition, use of the mark Lamaze®, as permitted under the terms of the license agreement, must be accompanied by the “®” symbol;
  • All use of the Licensed Marks in promotional and communications materials other than business cards and stationery (which requires the express written permission from Lamaze International, Inc.) must contain at least one conspicuous statement that “Lamaze is a registered trademark of Lamaze International, Inc.”;
  • Should you, the Licensee, violate any of the provisions of this agreement, Lamaze International, Inc., has the absolute right, at its sole discretion, to withdraw permission to use the Licensed Marks immediately and you, the Licensee, shall not be allowed to distribute any existing inventory or literature bearing the Lamaze® Licensed Marks;
  • You, the Licensee, agree to comply with all the provisions governing your user category as set forth in this Lamaze® Licensing Program, and that you shall not deviate from the provisions as outlined without the express written approval of Lamaze International Inc.; and
  • Lamaze International, Inc. assumes no liability for any claims, actions, injuries or legal expenses connected with or related to improper use of the licensed marks or the provision of any services carrying the Lamaze Licensed Marks as a result of granting permission to use the Licensed Marks and you agree to hold Lamaze International, Inc., harmless and indemnify Lamaze International, Inc., from any and all such claims, including costs of defending against same.
