Governance: Licensing Program
Purpose
The intent of this policy is to minimize public confusion about the source of Lamaze programs, activities and materials conducted by components of Lamaze International, and to maintain Lamaze International’s right to control the quality of the goods or services that are offered in conjunction with the Licensed Marks.

Licensing Program
This policy has been adopted to assure that the Lamaze name continues to be trusted and known for promoting normal, natural, healthy and fulfilling childbirth experiences for women and their families around the world. To protect our respected reputation and name recognition, Lamaze International has developed a formalized Lamaze Licensing Program, which is available to Lamaze International members, Lamaze Certified Childbirth Educators (LCCE educators), Lamaze International Chapters, and Lamaze Accredited Childbirth Educator Programs.

Lamaze Licensed Marks
The Lamaze® mark, the Belly Logo marks and the Certification Seal may be used, as specified in this policy, for purposes which advance the Lamaze mission, which is to promote, support and protect normal birth through education and advocacy.

It is the policy of Lamaze International that members, LCCE educators, chapters and childbirth educator programs may by licensed from Lamaze International to use the Lamaze mark, the Belly Logo marks and the Certification Seal, to promote childbirth education services as specified herein. No individual or group may use the Licensed Marks other than by license from Lamaze International, Inc. Lamaze International, Inc. is the exclusive owner of these Licensed Marks.

License Eligibility
There are five basic categories of individuals and groups affiliated with Lamaze International who may use the Licensed Marks as indicated below, strictly as specified in this policy: Lamaze International members; Lamaze Certified Childbirth Educators (LCCE educators) members/non-member; Lamaze International Chapters; and Lamaze Accredited Childbirth Educator Programs.

Lamaze International Members Who Are Not LCCE Educators
Lamaze International members who are not LCCE educators agree, in their applications/renewals for membership, to abide by Lamaze International bylaws, rules and policies, including those concerning use of the Licensed Marks of the organization. Current members of Lamaze International who are not LCCE educator certified are licensed only to identify themselves as "a member of Lamaze® International" or "a member of Lamaze®".

Lamaze International policy prohibits members who are not LCCE educator certified from stating or implying that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education.

Lamaze International Members Who Are LCCE Educator Certified
Lamaze International members who are LCCE educators agree, in their applications/renewals for membership, to abide by Lamaze International Inc. bylaws, rules and policies, including those concerning use of the Licensed Marks of the organization. They also agree, when applying for certification/recertification, that they will abide by the code of ethics established by the Lamaze Certification Council and Lamaze International, Inc. including those concerning use of the Licensed Marks. As long as members who are LCCE educator certified remain in good standing, they are licensed to use the Licensed Marks in the promotion of the Lamaze Philosophy of Birth as follows:

  • To identify themselves as "a member of Lamaze® International" or "a member of Lamaze®."
  • To indicate that they are "certified by Lamaze®" or are a "Lamaze Certified Childbirth Educator" or are "LCCE educator certified."
  • To state that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education and make reference to the Lamaze Philosophy of Birth.
  • To use the Lamaze Certification Seal in the promotion of the Lamaze Philosophy of Birth.
  • To use the Lamaze Belly Logo mark with the words 'Lamaze Certified Childbirth Educator & Member' in the promotion of the Lamaze Philosophy of Birth.

Lamaze Certified Childbirth Educators Who Are Not Members
Lamaze Certified Childbirth Educators (LCCE educators) who are non-members agree, when applying for certification/recertification, that they will abide by the code of ethics for LCCE educators and policies established by the Certification Council and Lamaze International, including those concerning use of the Licensed Marks. As long as non-member LCCE educators remain LCCE educators in good standing, they are licensed to use the Licensed Marks in the promotion of the Lamaze method of childbirth as follows:

  • To indicate that they are "certified by Lamaze®" or are a "Lamaze® Certified Childbirth Educator" or "LCCE educator certified."
  • To state that they offer Lamaze® classes, Lamaze® instruction, or Lamaze® childbirth education and make reference to the Lamaze Philosophy of Birth.
  • To use the Lamaze Certification Seal in the promotion of the Lamaze Philosophy of Birth.
  • Lamaze International policy prohibits the use of the Belly Logo by LCCE educators who are not members of Lamaze International.

Lamaze Childbirth Educator Programs
Each Lamaze Childbirth Educator Program executes an accreditation agreement and license which includes provisions regarding the following use of the Licensed Marks:

  • To state that the licensee offers the "Lamaze Childbirth Educator Program" (as long as the separately incorporated status of the program is disclosed).
  • To represent that the purpose of the licensee’s Lamaze Childbirth Educator Program is to teach students in the instruction of the Lamaze Philosophy of Birth and to prepare students to sit for the Lamaze examination to become certified by Lamaze.
  • To use the Lamaze Belly Logo mark with the words 'Accredited Lamaze® Childbirth Educator Program' in communications material.

Lamaze International Chapters
Each Lamaze International Chapter executes a charter which includes provisions regarding the following use of the Licensed Marks:

  • To identify the chapter as a "chapter of Lamaze International" or "a Lamaze International chapter" (as long as the separately incorporated status of the chapter is disclosed).
  • To use the Lamaze Belly Logo mark with the words 'Chapter of Lamaze® International' in communications material.

While Lamaze International chapters are allowed to use the Lamaze® mark and the Belly Logo for chapters as part of their organization identification, they are not authorized to license or permit the use of the name/logo by their individual members.

Usage of the Licensed Mark
Licensed individuals or organizations may use the Licensed Marks on business cards and stationary in accordance with this policy, without further written approval. All use of the Licensed Marks must clearly identify the licensee’s relationship with Lamaze International and must comply with Lamaze International graphics standards. The Licensed Marks may not, without permission from Lamaze International Inc., be used as part of a domain name or in any such manner that would imply or represent any connection with Lamaze International other than the individual’s or organization’s actual relationship as a member, LCCE educator, chapter or program. Lamaze International, Inc. will exercise control over the quality of goods and services offered in conjunction with the marks.

Requests for use of the Licensed Marks on promotional materials other than business cards and stationery must be submitted in writing to the Executive Director and must state the specific usage intended. Samples of the planned material, which must be in keeping with the Lamaze International philosophy and principles, must be included with requests. Promotional material may include such items as brochures, flyers or display ads.

Use of the Licensed Marks will be monitored and controlled by the Executive Director, under policy direction of the Lamaze International Board of Directors. No individual or group may use the Licensed Marks without the express written consent of the Executive Director, which cannot be given without a majority vote of the Lamaze International Board of Directors.

Licensed Marks may not be used in a manner which is in conflict with Lamaze International philosophy or principles. In case of uncertainty on proper use of the Licensed Marks, contact the Lamaze Administrative Office. Lamaze International, Inc. shall be the final judge as to whether any use of its Licensed Marks is consistent with the rules and policies of the Lamaze Licensing Program.

Applying for Use of the Lamaze® Licensed Marks
The Lamaze® mark, the Belly Logo marks and the Certification Seal are trademarks owned exclusively by Lamaze International, Inc. Use of these trademarks by approved individuals and organizations is by license from Lamaze International, Inc. as stated in this policy. Use in any other circumstances without written consent constitutes misappropriation and is subject to legal action. Lamaze International, Inc. retains the right to rescind permission if the Licensed Marks are used improperly.

Lamaze International members and/or LCCE educators are licensed to use certain terms/marks as outlined in this licensing program without further action. Only those individuals desiring to use the marks in a manner not already licensed are required to submit a licensing application form;. For example, a member LCCE educator who only intends to use the Lamaze marks as specified in this licensing policy need not submit any further application. The licensing agreement for these uses has been covered by membership and recertification applications. However, a member LCCE educator who would like to use the Lamaze marks, the Belly Logo mark or Certification Seal on promotional materials, such as brochures and flyers, must submit an application for use of these Licensed Marks.

Chapter and programs must sign a separate agreement with Lamaze International, Inc. allowing use of the Licensed Marks. Any use beyond that allowed by separate agreement must be applied for using the licensing application form.
